INFORMATIVA AL TRATTAMENTO DI DATI PERSONALI

art. 13 del Regolamento (UE) 2016/679

 

Gentile utente,

desideriamo informarla che, ai sensi dell’art. 13 del Regolamento (UE) 2016/679 (GDPR 2016/679), recante disposizioni a tutela delle persone fisiche rispetto al trattamento dei dati personali, i dati personali da Lei forniti formeranno oggetto di trattamento nel rispetto della normativa sopra richiamata e secondo i principi di liceità, correttezza, trasparenza e di tutela della Sua riservatezza e dei Suoi diritti.

Finalità del trattamento

I dati personali raccolti saranno trattati per le seguenti finalità:

• gestione delle attività di registrazione (art 6 comma 1 lett. b) per consentire l’accesso all’applicazione e fornire i servizi richiesti;
• Monitoraggio dell’utilizzo del macchinario, per la raccolta delle informazioni sulle ore di lavoro e utilizzo dello strumento per consentire le corrette attività di manutenzione.

Dati personali raccolti

Una volta installata, l’APP richiede all’utente l’accesso alle funzionalità presenti sul proprio dispositivo che potrebbero implicare il trattamento di dati personali. L’attivazione di alcune funzioni è necessaria per garantire il corretto funzionamento dell’APP (Bluetooth).

Al momento della registrazione verranno raccolti i seguenti dati personali:

• dati anagrafici (nome e cognome);
• dati di contatto (indirizzo e-mail);
• credenziali di accesso.

 

Modalità del trattamento

Il trattamento sarà svolto in forma automatizzata e/o manuale, con modalità e strumenti, nel rispetto delle misure di sicurezza di cui all’art. 32 del GDPR 2016/679, ad opera di soggetti appositamente incaricati, in ottemperanza a quanto previsto dagli art. 29 GDPR 2016/679. Saranno impiegate le misure di sicurezza atte a garantire la riservatezza del soggetto interessato cui tali dati si riferiscono e ad evitare l’indebito accesso a soggetti terzi o a personale non autorizzato.

Sono applicate misure di sicurezza che garantiscono la sicurezza dei dati degli utenti (pseudonimizzazione).

 

Conservazione

Le segnaliamo che, nel rispetto dei principi di liceità, limitazione delle finalità e minimizzazione dei dati, ai sensi dell’art. 5 GDPR 2016/679, il periodo di conservazione dei Suoi dati personali è stabilito per un arco di tempo non superiore al conseguimento delle finalità per le quali sono raccolti e trattati e nel rispetto dei tempi prescritti dalla legge.

L’utente può richiedere in qualsiasi momento la cancellazione del proprio profilo

 

Natura del Conferimento

Il conferimento dei dati è obbligatorio, l’eventuale rifiuto a fornirli determinerà l’impossibilità per Emak S.p.A. di assolvere agli obblighi di natura contrattuale, pregiudicando l’erogazione dei servizi offerti dall’applicazione.

 

Ambito di comunicazione e diffusione

I dati raccolti non saranno diffusi; i dati personali, in relazione alle finalità di cui sopra, potranno essere comunicati per l’adempimento di obblighi di legge.

 

Trasferimento dei dati a paesi terzi

Il Titolare del Trattamento non trasferisce i dati personali in paesi terzi; tuttavia si riserva la possibilità di utilizzare servizi in cloud e in tal caso i fornitori dei servizi saranno selezionati tra coloro che forniscono garanzie adeguate, così come previsto dall’art. 46 GDPR 2016/679.

 

Titolare, Responsabile del Trattamento e DPO

Il Titolare del Trattamento è Emak S.p.A., in persona del legale rappresentante.

L’elenco aggiornato dei responsabili e i dati di contatto del DPO nominato sono conservati presso la sede dell’attività.

Diritti dell’interessato

In ogni momento, Lei potrà esercitare, ai sensi degli artt. 15-22 del GDPR 2016/679, il diritto di:

• chiedere la conferma dell’esistenza o meno di propri dati personali e, in caso positivo, ottenere l’accesso ai dati personali ed alle informazioni indicate al punto b) che segue;
• ottenere le indicazioni circa le finalità del trattamento, le categorie dei dati personali, i destinatari o le categorie di destinatari a cui i dati personali sono stati o saranno comunicati (in particolare se destinatari di paesi terzi o organizzazioni internazionali) e, quando possibile, il periodo di conservazione;
• ottenere la rettifica e la cancellazione dei dati;
• ottenere la limitazione del trattamento;
• ottenere la portabilità dei dati, ossia riceverli da un titolare del trattamento, in un formato strutturato, di uso comune e leggibile da dispositivo automatico, e trasmetterli ad un altro titolare del trattamento senza impedimenti;
• opporsi al trattamento in qualsiasi momento ed anche nel caso di trattamento per finalità di marketing diretto;
• opporsi ad un processo decisionale automatizzato relativo alle persone fisiche, compresa la profilazione;
• ottenere conferma dell’adempimento di quanto previsto dall’art. 19 GDPR 2016/679 in capo al Titolare del Trattamento, ovvero la comunicazione – a ciascuno dei destinatari cui sono stati trasmessi i dati personali – delle eventuali rettifiche o cancellazioni o limitazioni del trattamento effettuate a norma dell’art. 16 GDPR 2016/679, eccetto il caso in cui tale adempimento si riveli impossibile o implichi uno sforzo sproporzionato;
• proporre reclamo alla competente autorità di controllo.

Dear User,

Pursuant to art. 13 of Regulation (EU) 2016/679 (GDPR 2016/679) on the protection of natural persons with regard to the processing of personal data, we wish to inform you that the personal data provided by you will be processed in compliance with the above Regulation, and in accordance with the principles of lawfulness, propriety, transparency and protection of your privacy and rights.

Purposes of processing

The personal data collected will be processed for the following purposes:

• administration of registration activities (art. 6, para. 1.b) to enable access to the APP and provide the services requested;
• monitor use of the machine in order to collect information about hours worked and usage, so that proper maintenance can be scheduled.

Personal data collected

On installation, the APP asks Users for access to the functionality available on their devices, which might involve the processing of personal data. Certain functions must be activated in order to ensure proper functioning of the APP (Bluetooth).

The following personal data will be collected at the time of registration:

• personal identification details (name and surname);
• contact details (e-mail address);
• access credentials.

 

Methods of processing

Processing will be carried in an automated and/or manual manner, using procedures and equipment that comply with the security measures specified in art. 32 GDPR 2016/679, by persons specifically authorized for that purpose pursuant to art. 29 GDPR 2016/679. Suitable security measures will be adopted to guarantee the confidentiality of the person to whom such data relates (data subject) and to avoid improper access by third parties or unauthorized personnel.

The above measures also guarantee the security of the personal data of Users (anonymization).

 

Retention

In compliance with the principles of lawfulness, restriction of purposes and data minimization, pursuant to art. 5 GDPR 2016/679, your personal data will not be retained for longer than necessary to achieve the purposes for which it was collected and processed, or for more than the maximum time specified by law.

Users may request the deletion of their personal profile at any time.

 

Nature of the provision of data

The provision of data is mandatory. Any refusal to provide it will make it impossible for Emak S.p.A. to satisfy its contractual obligations, compromising delivery of the services offered by the APP.

 

Scope of communications and dissemination

The data collected will not be disseminated; in relation to the purposes indicated above, personal data may communicated in order to comply with legal obligations.

 

Transfer of data to third countries

The Controller does not transfer personal data to third countries; however, the Controller reserves the right to use Cloud services and, in that case, the service providers will be selected from among those that provide adequate guarantees, as envisaged in art. 46 GDPR 2016/679.

Rights of Data Subjects

Pursuant to arts. 15-22 GDPR 2016/679, you may exercise at any time the rights to:

• obtain confirmation as to whether or not your personal data is being processed, and, where that is the case, obtain access to such personal data and the information indicated in point b) below;
• obtain information about the purposes of processing, the categories of personal data concerned, the recipients or categories of recipient to whom the personal data has been or will be disclosed (in particular recipients in third countries or international organizations) and, where possible, the retention period;
• obtain rectification or erasure of the data;
• obtain the restriction of processing;
• obtain the portability of the data, i.e. receive it from the Controller in a structured, commonly used and machine-readable format, and transmit it to another controller without hindrance;
• object to processing at any time, including to processing carried out for direct marketing purposes;
• object to an automated decision-making process relating to natural persons, including profiling;
• obtain confirmation of compliance by the Controller with art. 19 GDPR 2016/679, i.e. communication - to each of the recipients to which personal data has been disclosed - of any corrections or erasures or restrictions of processing carried out in accordance with art. 16 GDPR 2016/679, except if such compliance proves impossible or involves disproportionate effort;
• lodge a complaint with the competent supervisory authority.

DATENSCHUTZERKLÄRUNG GEMÄSS

Art. 13 Verordnung (EU) 2016/679

 

Sehr geehrter Nutzer,

wir möchten Sie darüber informieren, dass gemäß Art. 13 der Verordnung (EU) 2016/679 (DSGVO 2016/679), die Bestimmungen zum Schutz natürlicher Personen in Bezug auf die Verarbeitung personenbezogener Daten enthält, die von Ihnen bereitgestellten personenbezogenen Daten unter Beachtung der oben genannten Verordnung verarbeitet werden. Dabei werden die Grundsätze der Rechtmäßigkeit, Fairness, Transparenz sowie des Schutzes Ihrer Privatsphäre und Ihrer Rechte eingehalten.

Zwecke der Datenverarbeitung

Die erhobenen personenbezogenen Daten werden zu folgenden Zwecken verarbeitet:

• Verwaltung der Registriervorgänge (Art. 6 Abs. 1 Buchst. b) zur Ermöglichung des Zugriffs auf die Anwendung und zur Bereitstellung der angeforderten Dienste;
• Überwachung der Nutzung der Maschine zur Erfassung von Informationen über die Betriebsstunden und die Nutzung des Geräts, um ordnungsgemäße Wartungsarbeiten zu ermöglichen.

Erhobene personenbezogene Daten

Nach der Installation fordert die APP den Nutzer auf, den Zugriff auf die Funktionen seines Geräts zu erlauben, die die Verarbeitung personenbezogener Daten beinhalten können. Die Aktivierung bestimmter Funktionieren ist erforderlich, um das ordnungsgemäße Funktionieren der APP (Bluetooth) zu gewährleisten.

Bei der Registrierung werden folgende personenbezogene Daten erhoben:

• Stammdaten (Name und Nachname);
• Kontaktdaten (E-Mail-Adresse);
• Zugangsdaten.

 

Verarbeitungsmethoden

Die Verarbeitung erfolgt in automatisierter und/oder manueller Form, mit Methoden und Instrumenten, unter Beachtung der Sicherheitsmaßnahmen gemäß Art. 32 DSGVO 2016/679, durch speziell beauftragte Personen, in Übereinstimmung mit den Bestimmungen des Art. 29 DSGVO 2016/679. Es werden Sicherheitsmaßnahmen ergriffen, um die Privatsphäre der betroffenen Person, auf die sich diese Daten beziehen, zu schützen und unbefugten Dritten oder nicht autorisiertem Personal den unrechtmäßigen Zugang zu verhindern.

Es werden Sicherheitsmaßnahmen angewendet, die die Sicherheit der Nutzerdaten gewährleisten (Pseudonymisierung).

 

Speicherung

Wir weisen Sie darauf hin, dass im Einklang mit den Grundsätzen der Rechtmäßigkeit, Zweckbindung und Datenminimierung gemäß Art. 5 DSGVO 2016/679 die Speicherdauer Ihrer personenbezogenen Daten auf einen Zeitraum beschränkt ist, der nicht über die Erreichung der Zwecke hinausgeht, für die sie erhoben und verarbeitet wurden, und unter Beachtung der gesetzlich vorgeschriebenen Fristen.

Der Nutzer kann jederzeit die Löschung seines Profils verlangen

 

Art der Bereitstellung

Die Bereitstellung der Daten ist obligatorisch. Eine eventuelle Weigerung, diese bereitzustellen, führt dazu, dass das Unternehmen Emak S.p.A. seinen vertraglichen Verpflichtungen nicht nachkommen kann, was die Bereitstellung der von der Anwendung angebotenen Dienste beeinträchtigt.

 

Bereich der Kommunikation und Verbreitung

Die erhobenen Daten werden nicht verbreitet; die personenbezogenen Daten können jedoch im Zusammenhang mit den oben genannten Zwecken zur Erfüllung gesetzlicher Verpflichtungen weitergegeben werden.

 

Datenübermittlung an Drittländer

Der Verantwortliche übermittelt keine personenbezogenen Daten an Drittländer; er behält sich jedoch das Recht vor, Cloud-Dienste zu nutzen. In diesem Fall werden die Dienstanbieter aus denen ausgewählt, die angemessene Garantien bieten, wie es in Art. 46 DSGVO 2016/679 vorgesehen ist.

 

Verantwortlicher, Auftragsverarbeiter und DSB

Der Verantwortliche für die Datenverarbeitung ist Emak S.p.A., vertreten durch den gesetzlichen Vertreter.

Die aktuelle Liste der Auftragsverarbeiter sowie die Kontaktdaten des benannten DSB werden am Geschäftssitz aufbewahrt.

Rechte der betroffenen Person

Sie können jederzeit gemäß den Art. 15–22 DSGVO 2016/679 folgende Rechte ausüben:

• die Bestätigung über das Vorhandensein oder Nichtvorhandensein Ihrer personenbezogenen Daten zu verlangen und, falls diese vorhanden sind, Auskunft über die personenbezogenen Daten sowie über die im nachfolgenden Punkt b) aufgeführten Informationen zu verlangen;
• Angaben über die Zwecke der Verarbeitung, die Kategorien von personenbezogenen Daten, die Empfänger oder Kategorien von Empfängern, denen gegenüber die personenbezogenen Daten offengelegt wurden oder werden (insbesondere Empfänger in Drittländern oder internationale Organisationen) sowie, falls möglich, die Speicherdauer zu erhalten;
• die Berichtigung oder Löschung der Daten zu verlangen;
• die Einschränkung der Verarbeitung zu verlangen;
• die Datenübertragbarkeit zu verlangen, d. h. die Daten von einem Verantwortlichen in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten und sie ohne Hindernisse an einen anderen Verantwortlichen zu übermitteln;
• jederzeit Widerspruch gegen die Verarbeitung einzulegen, auch wenn die Verarbeitung für Zwecke der Direktwerbung erfolgt;
• Widerspruch gegen eine automatisierte Entscheidungsfindung, die natürliche Personen betrifft, einschließlich Profiling, einzulegen;
• eine Bestätigung über die Erfüllung der in Art. 19 DSGVO 2016/679 vorgesehenen Verpflichtungen seitens des Verantwortlichen zu erhalten, d. h. die Mitteilung an jeden Empfänger, dem die personenbezogenen Daten übermittelt wurden, über etwaige Berichtigungen, Löschungen oder Einschränkungen der Verarbeitung, die gemäß Art. 16 DSGVO 2016/679 vorgenommen wurden, es sei denn, eine solche Mitteilung ist unmöglich oder würde einen unverhältnismäßigen Aufwand erfordern;
• bei der zuständigen Aufsichtsbehörde eine Beschwerde einzureichen.

POLÍTICA DE TRATAMIENTO DE LOS DATOS PERSONALES

Art. 13 del Reglamento (UE) 2016/679

 

Estimado usuario,

Deseamos informarle de que, en virtud del art. 13 del Reglamento (UE) 2016/679 (RGPD 2016/679), por el que se establecen disposiciones para la protección de las personas físicas en lo que respecta al tratamiento de datos personales, los datos personales que nos facilite serán tratados en cumplimiento de la citada normativa y de acuerdo con los principios de licitud, lealtad, transparencia y protección de su confidencialidad y sus derechos.

Fines del tratamiento

Los datos personales recogidos se tratarán con los siguientes fines:

• gestión de las actividades de registro (art. 6, apdo. 1, letra b) para permitir el acceso a la solicitud y prestar los servicios solicitados;
• Seguimiento del uso de la máquina, para la recogida de información sobre las horas de trabajo y el uso de la herramienta para permitir actividades de mantenimiento correctas.

Datos personales recogidos

Una vez instalada, la APP requiere que el usuario acceda a funciones en su dispositivo que podrían implicar el tratamiento de datos personales. La activación de algunas funciones es necesaria para garantizar el funcionamiento correcto de la APP (Bluetooth).

En el momento del registro se recogerán los siguientes datos personales:

• señas personales (nombre y apellidos);
• datos de contacto (dirección de correo electrónico);
• credenciales de acceso.

 

Modalidades de tratamiento

El tratamiento se llevará a cabo de forma automatizada y/o manual, utilizando métodos y herramientas que respetan las medidas de seguridad establecidas en el art. 32 del RGPD 2016/679, por personas especialmente designadas, en cumplimiento de lo dispuesto en el artículo 29 RGPD 2016/679. Se emplearán medidas de seguridad para garantizar la confidencialidad del interesado al que se refieren dichos datos y para evitar el acceso indebido por parte de terceros o personal no autorizado.

Se aplican medidas de seguridad para garantizar la seguridad de los datos de los usuarios (seudonimización).

 

Conservación

Le informamos de que, de conformidad con los principios de licitud, limitación de la finalidad y minimización de datos, en virtud del art. 5 RGPD 2016/679, el período de conservación de sus datos personales queda establecido por un lapso de tiempo no superior a la consecución de los fines para los que se recogen y tratan y respetando los plazos previstos por la ley.

El usuario puede solicitar en cualquier momento la supresión de su perfil

 

Naturaleza de la aportación

La aportación de los datos es obligatoria. La negativa a suministrar dichos datos imposibilitará a Emak S.p.A. el cumplimiento de sus obligaciones contractuales y perjudicará la prestación de los servicios ofrecidos por la aplicación.

 

Ámbito de comunicación y difusión

Los datos recogidos no serán difundidos; los datos personales, en relación con los fines arriba indicados, podrán ser comunicados para el cumplimiento de obligaciones legales.

 

Transferencia de datos a terceros países

El Responsable del Tratamiento no transfiere datos personales a terceros países; sin embargo, se reserva la posibilidad de utilizar servicios en la nube y, en este caso, los proveedores de servicios se seleccionarán entre aquellos que ofrezcan garantías adecuadas, según lo dispuesto en el artículo 46 RGPD 2016/679.

 

Responsable, Encargado del Tratamiento y Delegado de Protección de Datos (DPO)

El Responsable del Tratamiento es Emak S.p.A., en la persona de su representante legal.

La lista actualizada de los Encargados y los datos de contacto del DPO designado se conservan en la sede de la actividad.

 

Para hacer valer los derechos del interesado y/o solicitar más información, puede dirigirse al Responsable del Tratamiento «Emak S.p.A.», con domicilio social y sede del tratamiento en Via Fermi 4, Bagnolo in Piano (RE) –tel. 0522 956611– o poniéndose en contacto con el DPO mediante la dirección dpo@emak.it.

 

Derechos del interesado

En cualquier momento, usted podrá ejercer, de conformidad con los artículos 15-22 del RGPD 2016/679, el derecho a:

• solicitar confirmación de la existencia o no de sus datos personales y, en caso afirmativo, obtener acceso a los datos personales y a la información indicada en la letra b) siguiente;
• obtener indicaciones sobre los fines del tratamiento, las categorías de datos personales, los destinatarios o las categorías de destinatarios a los que se han comunicado o se comunicarán los datos personales (en particular, si se trata de destinatarios en terceros países u organizaciones internacionales) y, cuando sea posible, el período de conservación;
• obtener la rectificación y la supresión de los datos;
• obtener la limitación del tratamiento;
• obtener la portabilidad de los datos, es decir, recibirlos de un responsable del tratamiento, en un formato estructurado, de uso común y lectura mecánica, y transmitirlos a otro responsable del tratamiento sin que lo impida el responsable al que se los hubiera facilitado;
• oponerse al tratamiento en todo momento y también en caso de tratamiento con fines de mercadotecnia directa;
• oponerse a decisiones individuales automatizadas, incluida la elaboración de perfiles;
• obtener confirmación de que el Responsable del Tratamiento ha cumplido lo dispuesto en el art. 19 RGPD 2016/679, es decir, la comunicación –a cada uno de los destinatarios a los que se hayan transmitido los datos personales– de cualquier rectificación o supresión o limitación del tratamiento llevada a cabo de conformidad con el art. 16 RGPD 2016/679, excepto cuando dicho cumplimiento resulte imposible o suponga un esfuerzo desproporcionado;
• presentar una reclamación ante la autoridad de control competente.

POLITIQUE EN MATIÈRE DE TRAITEMENT DES DONNÉES À CARACTÈRE PERSONNEL

Cher utilisateur,

nous vous informons que, conformément à l'art. 13 du Règlement (UE) 2016/679 (RGPD 2016/679), relatif à la protection des personnes physiques à l'égard du traitement des données à caractère personnel, les données à caractère personnel que vous fournissez seront traitées conformément aux principes de licéité, loyauté, transparence et protection de votre vie privée et de vos droits.

Finalités du traitement

Les données à caractère personnel collectées seront traitées pour les finalités suivantes :

• gestion des activités d’enregistrement (art 6, paragraphe 1, lettre b) pour permettre l'accès à l’application et fournir les services demandés ;
• suivi de l'utilisation de la machine, pour la collecte d'informations sur les heures de travail et l'utilisation de l'outil afin de permettre des activités d'entretien correctes.

Données à caractère personnel collectées

Une fois installée, l'APPLI demande à l'utilisateur d'accéder à des fonctions de son appareil qui peuvent impliquer le traitement de données à caractère personnel. L'activation de certaines fonctions est nécessaire pour assurer le bon fonctionnement de l'APPLI (Bluetooth).

Au moment de l'enregistrement, les données à caractère personnel collectées sont les suivantes :

• identité (nom et prénom) ;
• coordonnées (adresse e-mail) ;
• identifiants d'accès.

 

Modalités de traitement

Le traitement sera effectué sous forme automatisée et/ou manuelle, en utilisant des méthodes et des outils conformes aux mesures de sécurité énoncées à l'article 32 du RGPD 2016/679, par des personnes spécialement désignées, conformément aux dispositions de l'article 29 du RGPD 2016/679. Des mesures de sécurité sont mises en œuvre pour garantir la confidentialité de la personne concernée par ces données et pour empêcher tout accès indu par des tiers ou du personnel non autorisé.

Des mesures de sécurité sont appliquées pour garantir la sécurité des données des utilisateurs (pseudonymisation).

 

Conservation des données à caractère personnel

Nous vous informons que, conformément aux principes de licéité, de limitation des finalités et de minimisation des données, aux termes de l'article 5 du RGPD 2016/679, la durée de conservation de vos données à caractère personnel ne doit pas excéder la durée nécessaire à la réalisation des finalités pour lesquelles elles sont collectées et traitées et, quoi qu’il en soit, la durée prescrite par la loi.

Nature de la fourniture des données à caractère personnel

La fourniture des données est obligatoire. Tout refus de fournir ces données mettra Emak S.p.A. dans l'impossibilité de remplir ses obligations contractuelles et portera préjudice à la fourniture des services offerts par l'application.

 

Communication et diffusion des données à caractère personnel

Les données collectées ne seront pas diffusées ; les données à caractère personnel, en relation avec les finalités susmentionnées, pourront être communiquées pour l'accomplissement d'obligations légales.

 

Transfert des données à caractère personnel vers des pays tiers

Le responsable du traitement ne transfère pas de données à caractère personnel vers des pays tiers ; il se réserve toutefois la possibilité d'utiliser des services dans le cloud et, dans ce cas, les fournisseurs des services seront sélectionnés parmi ceux qui offrent des garanties appropriées, comme le prévoit l'article 46 du RGPD 2016/679.

Droits de la personne concernée

• obtenir la rectification et l'effacement des données ;
• obtenir la limitation du traitement ;
• obtenir la portabilité des données, c'est-à-dire les recevoir d'un responsable du traitement, dans un format structuré, couramment utilisé et lisible par machine, et ont le droit de transmettre ces données à un autre responsable du traitement sans que le responsable du traitement auquel les données à caractère personnel ont été communiquées y fasse obstacle ;
• s'opposer au traitement à tout moment, même s’il s’agit d'un traitement à des fins de marketing direct ;
• s'opposer à un processus de prise de décision automatisé concernant des personnes physiques, y compris le profilage ;
• obtenir la confirmation que le responsable du traitement a respecté l'article 19 du RGPD 2016/679, et a notifié – à chacun des destinataires auxquels les données à caractère personnel ont été communiquées – toute rectification, tout effacement ou toute limitation du traitement effectué en vertu de l'article 16 du RGPD 2016/679, à moins qu'une telle communication se révèle impossible ou exige des efforts disproportionnés ;

POLITYKA PRZETWARZANIA DANYCH OSOBOWYCH

zgodnie z art. 13 rozporządzenia (UE) 2016/679

 

Drodzy użytkownicy,

niniejszym informujemy, że zgodnie z art. 13 rozporządzenia (UE) 2016/679 (RODO 2016/679) ustanawiającego przepisy dotyczące ochrony osób fizycznych w związku z przetwarzaniem danych osobowych, podane przez użytkownika dane osobowe będą przetwarzane zgodnie z wyżej wymienionymi przepisami oraz zgodnie z zasadami zgodności z prawem, prawidłowości, przejrzystości i ochrony jego prywatności i praw.

Cel przetwarzania danych

Zebrane dane osobowe będą przetwarzane w celach takich jak:

• zarządzanie czynnościami rejestracyjnymi (art. 6 ust. 1 lit. b) w celu umożliwienia dostępu do aplikacji i świadczenia żądanych usług;
• monitorowanie użytkowania maszyn w celu gromadzenia informacji na temat godzin pracy i użytkowania narzędzia, aby umożliwić prawidłowe czynności konserwacyjne.

Gromadzone dane osobowe

Po zainstalowaniu aplikacja wymaga od użytkownika dostępu do funkcji na jego urządzeniu, co może wiązać się z przetwarzaniem danych osobowych. Aktywacja niektórych funkcji jest niezbędna do zapewnienia prawidłowego działania aplikacji (Bluetooth).

Podczas rejestracji gromadzone będą następujące dane osobowe:

• dane osobowe (imię i nazwisko);
• dane kontaktowe (adres e-mail);
• dane dostępowe.

 

Metody przetwarzania danych

Przetwarzanie danych będzie odbywać się w sposób zautomatyzowany i/lub ręczny, przy użyciu metod i narzędzi zgodnych ze środkami bezpieczeństwa określonymi w art. 32 rozporządzenia RODO nr 2016/679, przez specjalnie wyznaczone osoby, zgodnie z postanowieniami zawartymi w art. 29 rozporządzenia RODO nr 2016/679. Stosowane będą środki bezpieczeństwa w celu zapewnienia poufności danych osoby, której dane dotyczą, oraz w celu zapobieżenia nieuprawnionemu dostępowi osób trzecich lub nieupoważnionego personelu.

Środki bezpieczeństwa są stosowane w celu zapewnienia bezpieczeństwa danych użytkownika (pseudonimizacja).

 

Przechowywanie

Informujemy, że zgodnie z zasadami zgodności z prawem, ograniczenia celu i minimalizacji zakresu danych, zgodnie z art. 5 rozporządzenia RODO nr 2016/679, okres przechowywania danych osobowych użytkownika jest ustalany na czas nieprzekraczający realizacji celów, dla których są one gromadzone i przetwarzane oraz zgodnie z terminami określonymi w przepisach prawa.

Użytkownikom przysługuje prawo do zażądania usunięcia swojego profilu w dowolnym momencie.

 

Charakter danych

Podanie danych jest obowiązkowe. Odmowa ich podania uniemożliwi spółce Emak S.p.A. wypełnienie jej zobowiązań wynikających z umowy i będzie mieć negatywny wpływ na świadczenie usług oferowanych przez aplikację.

 

 

 

Zakres komunikacji i rozpowszechniania

Zebrane dane nie będą rozpowszechniane; dane osobowe, w związku z powyższymi celami, mogą być przekazywane w celu wypełnienia zobowiązań prawnych.

 

Przekazywanie danych do państw trzecich

Administrator danych nie przekazuje danych osobowych do państw trzecich; zastrzega sobie jednak możliwość korzystania z usług w chmurze i w takim przypadku dostawcy usług zostaną wybrani spośród tych, którzy zapewniają odpowiednie gwarancje, zgodnie z art. 46 rozporządzenia RODO nr 2016/679.

 

Administrator danych, podmiot przetwarzający dane i inspektor ochrony danych

Administratorem danych jest Emak S.p.A. w osobie swojego przedstawiciela prawnego.

Aktualna lista podmiotów przetwarzających dane oraz dane kontaktowe wyznaczonego inspektora ochrony danych są przechowywane w siedzibie firmy.

Prawa zainteresowanej strony

Zgodnie z art. 15-22 rozporządzenia RODO nr 2016/679 użytkownik może w każdej chwili skorzystać z prawa do:

• żądania potwierdzenia istnienia lub braku istnienia danych osobowych, a jeżeli ma to miejsce, uzyskania dostępu do danych osobowych i informacji wskazanych w punkcie b) poniżej;
• uzyskania informacji o celach przetwarzania, kategoriach danych osobowych, odbiorcach lub kategoriach odbiorców, którym dane osobowe zostały lub zostaną ujawnione (w szczególności wtedy, gdy są to odbiorcy w państwach trzecich lub organizacjach międzynarodowych) oraz, w miarę możliwości, o okresie ich przechowywania;
• uzyskania sprostowania i usunięcia danych;
• uzyskania ograniczenia przetwarzania;
• uzyskania możliwości przenoszenia danych, tj. otrzymania ich od administratora danych w ustrukturyzowanym, powszechnie używanym formacie nadającym się do odczytu maszynowego oraz przesłania ich bez przeszkód innemu administratorowi danych;
• wniesienia sprzeciwu wobec przetwarzania w dowolnym momencie, a także w przypadku przetwarzania do celów marketingu bezpośredniego;
• wniesienia sprzeciwu wobec zautomatyzowanego procesu podejmowania decyzji dotyczących osób fizycznych, w tym profilowania;
• uzyskania potwierdzenia, że Administrator Danych zastosował się do przepisów art. 19 rozporządzenia RODO nr 2016/679, tj. poinformowania - każdego z odbiorców, którym przekazano dane osobowe - o wszelkich sprostowaniach lub usunięciach lub ograniczeniach przetwarzania dokonanych na podstawie art. 16 rozporządzenia RODO nr 2016/679, z wyjątkiem sytuacji, gdy takie zastosowanie się okaże się niemożliwe lub będzie wymagało niewspółmiernie dużego wysiłku;
• złożenia skargi do właściwego organu nadzorczego.
